1. Who we are
LeadRecover ("LeadRecover", "we", "us") is operated by Ariel Wainer ("the Seller"). By accessing or using LeadRecover, you ("you", "the user") agree to these Terms & Conditions. If you do not agree, do not use the service.
2. The service
LeadRecover is a software-as-a-service application that helps local service businesses capture, track, and follow up with sales leads. You must provide accurate registration information, keep your account credentials confidential, and are responsible for activity under your account. If you sign up on behalf of an organization, you confirm you have authority to bind it.
3. Acceptable use
You must not misuse the service. In particular, you must not:
- use the service for any unlawful, fraudulent, or deceptive purpose, or to send spam;
- infringe any intellectual property, privacy, or other rights of any party;
- upload malware, attempt to gain unauthorized access, probe, scan, or interfere with the security or integrity of the service;
- scrape, reverse engineer, decompile, or attempt to extract source code, except to the extent permitted by law;
- resell, sublicense, or redistribute the service without our written consent.
4. Intellectual property
The service, including all software, documentation, branding, and content we provide, is and remains the exclusive property of the Seller and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the service in accordance with your subscription plan. You retain ownership of the data and content you submit to the service ("User Content") and grant us a limited license to host, store, and process it solely to provide the service.
5. Service availability
We work to keep the service running reliably but do not guarantee that it will be uninterrupted, error-free, or always available. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
6. Payments, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Subscription terms, billing frequency, taxes, renewals, cancellations, and refunds are governed by Paddle's Buyer Terms and our Refund Policy.
7. Suspension and termination
We may suspend or terminate your access to the service for material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the service ends. We will, where reasonably possible, allow you a period to export your data before deletion.
8. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or related to the service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, special, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these terms limits liability for fraud, death, personal injury caused by negligence, or any other liability that cannot be limited by law.
9. Indemnity
You agree to indemnify and hold the Seller harmless from any claims, damages, or expenses arising from your User Content, your unlawful use of the service, or your breach of these terms.
10. Changes to these terms
We may update these terms from time to time. Material changes will be communicated through the service or by email. Continued use of the service after changes take effect constitutes acceptance.
11. Governing law
These terms are governed by the laws of the Seller's jurisdiction of residence, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
